Barron Adler Clough & Oddo files amicus brief in the Supreme Court of Texas regarding condemnation of private property for a pipeline

Barron Adler Clough & Oddo, LLP, continues in its efforts to protect landowner rights throughout the State of Texas. A long running case over whether a pipeline company has the right to take property near the Texas gulf coast is now pending at the Supreme Court of Texas for a second time. On February 29, 2016, Barron & Adler filed an amicus or “friend of the court” brief arguing that pipeline companies have a much lower burden to condemn in contrast to other condemning authorities throughout Texas. Specifically, the amicus brief suggests that landowners need a meaningful opportunity to seek judicial review and to test a purported common carrier’s alleged power to condemn.
